Terms & Conditions

These Terms and Conditions ("Terms") govern your engagement with Magnivate Consulting Services ("we," "our," "us"). By using our services, you agree to be bound by these Terms. If you do not agree, please do not proceed.

1. Service Overview

Career Services: Job readiness training, resume assistance, interview preparation, career coaching, and workplace orientation for individuals.

Visa Services: General information and referral to registered migration agents; we are not registered migration agents and do not provide migration advice.

Recruitment Services: Sourcing, screening, and referring candidates to businesses for employment purposes.

Specific service details, deliverables, and fees will be outlined in your service agreement or engagement letter.

2. Eligibility

For individuals: Must be at least 18 years old. We may request proof of identity or visa status where relevant to service delivery.

For businesses: Must be legally registered and authorised to engage recruitment services in Australia.

We reserve the right to refuse service if eligibility requirements are not met.

3. Fees and Payment

• Fees are quoted in Australian Dollars (AUD) and include applicable taxes unless stated otherwise.
• Payment terms (full payment or instalments) will be specified in your service agreement.
• All payments are nonrefundable except as required under Australian Consumer Law.

4. Cancellations and Refunds

• Cancellations within 48 hours of purchase may be eligible for a full refund, provided no services have been accessed or commenced.
• No refunds will be granted after services have commenced.
• Refunds, if applicable, will be processed within 30 to 60 business days.

We may reschedule or modify services with reasonable notice due to unforeseen circumstances.

5. Client Responsibilities

You agree to:

• Provide accurate and complete information.
• Attend scheduled sessions or meet agreed deadlines.
• Not share confidential materials without written permission.
• Engage respectfully with our staff and representatives.

Inappropriate, disruptive, or dishonest behaviour may result in termination of services without refund 

6. Intellectual Property

All content, materials, and resources we provide remain our intellectual property and are for your personal or internal business use only. You may not copy, distribute, or reproduce materials without our express written consent.

7. Disclaimers

Career Services: We do not guarantee employment, interviews, or specific outcomes. Final hiring decisions rest with employers.

Visa Services: We are not registered migration agents. Any migration advice will be provided by a partnered registered migration agent under separate terms.

Recruitment Services: We do not guarantee that a placement will be made or that a candidate will meet all employer requirements. We conduct reasonable screening but final hiring decisions and employment arrangements are between the employer and candidate.

8. Limitation of Liability

To the extent permitted by law, we are not liable for any direct or indirect loss or damage arising from our services. If we fail to meet a guarantee under Australian Consumer Law, our liability is limited to either resupplying the service or providing a refund, at our discretion.

9. Privacy

We collect and handle personal information in accordance with our Privacy Policy. By engaging our services, you consent to our use of your information for service delivery and related communications. We do not share information with third parties without consent, except as required by law or necessary for recruitment purposes (e.g., sharing candidate details with prospective employers).

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising out of these Terms will be subject to the exclusive jurisdiction of the courts of that State.

11. Amendments

We may update these Terms at any time by publishing a revised version on our website. Continued use of our services constitutes acceptance of the updated Terms.
